Register now to participate in ACS’ 2010 Constance Baker Motley National Moot Court Competition in Constitutional Law. The 2010 Moot Court legal problem involves fundamental questions about our national security and the basic rights guaranteed by the Constitution to persons lawfully residing in the United State.
Two issues will be briefed and argued:
* Whether the Authorization for Use of Military Force, Pub. L. No. 107-40, 115 Stat. 224 (2001) (AUMF), authorizes, and if so whether the Constitution allows, the seizure and indefinite military detention of a person lawfully residing in the United States, without criminal charge or trial, based on government assertions that the detainee conspired with al Qaeda to engage in terrorist activities?; and
* Whether the process afforded by the district court to challenge a designation as an “enemy combatant” was sufficient under the requirements of the Fifth Amendment?
The competition will consist of two preliminary regional competition rounds in San Francisco, CA (March 2010) and Suffolk University Law School (March 27-March 28). At each regional competition, teams of two will argue a minimum of three preliminary rounds on Saturday, and eight (8) teams will advance to the quarterfinal level of elimination rounds on Sunday. From that four (4) teams will advance to a semi-final elimination round, and then two (2) teams will advance to a regional competition final round.
The winning team from each regional competition will compete in The Constance Baker Motley National Moot Court Competition in Constitutional Law Final Round this upcoming summer at the ACS 2010 National Convention in Washington, D.C. The winning team selected in the Final Round will receive a $3,000 cash prize, and the runner-up team will each receive a $2,000 cash prize. Registration will close on November 20, 2009.

* March 27-28, 2010: East Coast Regional Competition Rounds
* June 2010: Final Round at ACS National Convention
